Notice Pursuant to Section 114 Land Transfer Act 2017

An application under section 114 of the Land Transfer Act 2017 has been received for the removal of an easement. The applicant claims the easement is extinguished by reason of the circumstances set out below.

If no objections have been received before 16 May 2024, the Register will be updated to record the easement as redundant.

Applicant: Hillgrove Trustee Limited, C/o Harkness Henry, Private Bag 3077, Waikato Mail Centre, Hamilton 3240.

Circumstances: Clause 2(ii) of easement instrument B612143.3 provides that the easement expires when Andrew Craig Steenson and Patricia Mary Steenson (or any associated entity to which Andrew Craig Steenson and Patricia Mary Steenson are associated with) are no longer a registered owner of Lot 1 DPS 87821 contained in RT SA69A/446 (the benefitted land). Andrew Craig Steenson and Patricia Mary Steenson or any of their entities are no longer a registered owner of the benefited land and as a result the easement has no practical effect.

Easement: Right to convey water marked C, D and E on DP 522498 in Record of Title (RT) 828997 owned by Hillgrove Trustee Limited for the benefit of Lot 1 DPS 87821 in RT SA69A/446 owned by Christine Maree Torrens, Archibald Bruce Torrens and NP Legal Trustees Limited specified in Easement Certificate B612143.3
