Notice of Entry into Possession of Mortgaged Goods

In the matter of section 156 of the Property Law Act 2007 and in the matter of the mortgage over goods (a Commercial Loan Facility Agreement dated 19 October 2020, a Commercial Loan Facility Agreement dated 20 November 2020 and a Commercial Loan Facility Agreement dated 29 July 2021) (“Mortgage”) over: 2018 Sinotruck T5G 330 Registration No. LPK314, VIN LZZ1BXNB9GW221850; 2008 Suzuki Swift Registration No. JBK905, VIN 7AT0GK0CX15443387; 2012 Ford Mondeo 2.0TD A Hatchback Registration No. GKQ884, VIN WF0EXXGBBEBU00132; 2004 Hino FM IJRPA-WGU Registration No. CDG493, VIN JHDFM1JRPXXX10143; 2017 Isuzu F Series FYH MAN Truck Registration No. KSP134, VIN JALFYH77TF7000569 (“Collateral”).

Notice is hereby given that on 23 January 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, Musa and Shary PVT Limited, to comply with the terms of the mortgage.

The registered office of the Mortgagee is 35 Teed Street, Newmarket, Auckland.
