Notice Pursuant to Section 115 of the Land Transfer Act 2017

The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of an Easement at North Auckland. The applicant claims the easement described below is redundant by reason of the circumstances set out below.

You may object by giving notice to the Registrar-General of Land. I intend to remove the Easement on 8 December 2023 if no objections have been received before that date.

Applicant: Joanna Mourne Wood, Stephen Graham Wood and Awana Trustees Limited, c/ Malloy Goodwin Harford, PO Box 9892, Newmarket, Auckland 1149.

Easement: Right to developing and planting over Lot 1 DP 151168 marked H and I on DP 151168 in Record of Title (RT) NA89D/828 (“burdened land”) owned by Lin Guo and NWM Trustees 174 Limited granted to Lot 3 DP 581724, 1/3 share in Lot 100 DP 581724 and 1/2 share in Lot 101 DP 581724 RT 1092079 (“benefiting land”) owned by Stephen Graham Wood, Joanna Mourne Wood and Awana Trustees Limited in Transfer C407683.10 registered on 26 August 1992.

Circumstances: The benefited land no longer adjoins the burdened land as a result of a subdivision shown on Plan DP 581724.
