Notice Pursuant to Section 114 of the Land Transfer Act 2017

The applicants described below have applied under section 114 of the Land Transfer Act 2017 for the removal of the Forestry Right at Marlborough. The applicants claim the Forestry Right is extinguished by reason of the circumstances set out below.

I intend to remove the easement on 22 August 2023 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 18 August 2023.

Applicants: Huimei Investment (NZ) Pty Limited, Flat 2210, The Quadrant On Waterloo, 10 Waterloo Quadrant, Auckland Central, Auckland 1010.

Easement: Forestry Right over Lot 1 Deposited Plan 477357 and Section 3 Block XVI Arapawa Survey District in Record of Title 661397 and over Lot 23 Deposited Plan 491060 in Record of Title 710732.

Circumstances: Extinguished because an event specified in the document creating it occurred and brought it to an end. Clause 3.1 of the Forestry Right instrument states the term of this agreement shall commence on the date of this agreement and terminate at the adjustment date immediately following the completion of harvesting of the forest or ten (10) years after the commencement date whichever shall first occur. The event that the Forestry Right was terminated on 30 November 2021 because of completion of harvesting.
