Notice is given under section 173(1) of the Land Transfer Act 2017 of the following application to bring part of the dry bed of the Waiwakaiho River under the Act and issue a record of title for it made under section 172(1)(a) of the Act.

Application 12516782.5 by Linda Marie Way, c/- C & M Legal, 53 Brougham Street, New Plymouth 4310, Attention: Nic Croft, for land at 20 and 20A Gordon Street, New Plymouth in the New Plymouth District being 0.0559, 0.0188 and 0.0204 hectares, more or less, and shown as part Lot 1 on LT Plan 549464 being part of the former bed of Waiwakaiho River adjoining Lot 6 DP 8558 comprised in Record of Title TNC2/367, Lot 1 DP 542857 comprised in Record of Title 937426 and Lot 2 DP 542857 comprised in Record of Title 937427 respectively in the Taranaki Land Registration District. The applicant claims to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim for title.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 21 August 2023. If no caveats are lodged, a record of title will be issued in the name of the applicant.
