Pursuant to sections 20(1) and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Cade Couch, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the easements described in the First Schedule to this notice are acquired for wastewater purposes over the land of Moomook Management Limited (“Grantor”) described in the First Schedule in favour of the land of Manawatu District Council (“Grantee”) described in the Second Schedule to this notice upon the terms and conditions set out in the Third Schedule to this notice on the date of publication of this notice in the New Zealand Gazette.

Right of way, right to convey telecommunications and right to convey electricity easements Marked A on DP 43381 over part Lot 2 DP 43381 (part Record of Title WN15B/1313) (“Burdened Land”).

Second Schedule

The Grantee’s Land

Lot 1 DP 42023 (Record of Title WN15B/910) and Section 1 SO 302447 (Record of Title 16559) (“Benefited Land”).

Third Schedule

Easement Rights and Powers

The rights and powers implied in the specified classes of easement are those prescribed by Schedule 5 to the Land Transfer Regulations 2018.
