Hazardous Substances (International Regulators) Notice 2023

This notice is issued by the Environmental Protection Authority (“Authority”) under section 76E of the Hazardous Substances and New Organisms Act 1996 (“Act”).

It is issued in accordance with section 76E(1) of the Act, having had regard to the matters specified in sections 76E(2) and (3) of the Act.

The Authority now approves it for publication in the New Zealand Gazette.

Objective of Notice

The purpose of this notice is to recognise the listed overseas bodies as international regulators for the purposes of sections 28A and 63D of the Act.

This notice is a new notice under section 76E of the Act.

Extent of Consultation

The Authority publicly notified its intention to issue a notice with a list of international regulators on 30 March 2023 by publishing a consultation document on its website. It invited submissions by 24 May 2023. The proposed list and the reasons for including the overseas bodies in the proposed list were provided in this consultation document.

The consultation document was also sent to interested persons in accordance with section 76E(2)(c) of the Act.

Comments received from submitters in response to the public notification and comments received from consultation with interested persons were taken into account by the Authority during the drafting of this notice.

1. Title

This is the Hazardous Substances (International Regulators) Notice 2023.

2. Commencement

This notice comes into force on 1 October 2023.

3. List of International Regulators

(1) Having considered the matters listed in section 76E(3) of the Act the Authority recognises the following overseas bodies as international regulators under section 76E(1) of the Act, which at the date of this notice are known as:
