Pursuant to section 52Q of the Commerce Act 1986 (“Act”), the Commerce Commission (“Commission”) gives notice that it has amended the information disclosure requirements applicable to airport services, electricity distribution services, gas distribution services, and gas transmission services under Part 4 of the Act.

The amended information disclosure determinations are:

• Commerce Act (Specified Airport Services Information Disclosure) Determination (Decision 715, 22 December 2010)
• Electricity Distribution Information Disclosure Determination 2012 [2012] NZCC 22
• Gas Distribution Information Disclosure Determination 2012 [2012] NZCC 23
• Gas Transmission Information Disclosure Determination 2012 [2012] NZCC 24

The amendments are set out in the following determinations:

• Airport Services Information Disclosure Amendments Determination 2017 [2017] NZCC 36
• Electricity Distribution Information Disclosure Amendments Determination 2017 [2017] NZCC 33
• Gas Distribution Information Disclosure Amendments Determination (No.2) 2017 [2017] NZCC 34
• Gas Transmission Information Disclosure Amendments Determination (No.2) 2017 [2017] NZCC 35

The amendments come into effect on the date of this notice.

The scope of the amendments cover:

• changes to requirements consequential on the input methodologies review (including for electricity distribution businesses and gas pipeline businesses, changes to our related parties requirements);
• changes to align asset grading requirements for electricity distribution businesses with the Electricity Engineers’ Association’s asset health indicator guide; and
• less complex administrative updates to requirements picked up as part of our compliance testing work or identified by users of the information disclosure determinations.
