Notice of Exemption From Maritime Rules and Marine Protection Rules

Pursuant to sections 47(3) and 395(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions for the period 13 October 2017 and 10 November 2017 inclusive:

  • 1 from Maritime Rule 22, Appendix 1, 3(4) – Collision Prevention – Power-driven vessels underway must exhibit masthead light forward – Horizontal positioning and spacing of lights.
  • 1 from Maritime Rule 31.25(1) – Crewing and Watchkeeping – General crewing and other requirements – Duty of crew to hold certificates and to be able to demonstrate ancillary proficiencies – Specific certificate or endorsement or higher grade of certificate or endorsement.
  • 1 from Maritime Rule 31.44(b), Table 6 – Crewing and Watchkeeping – SOLAS and STCW ships – Coastal and offshore limits – Ships operating beyond restricted limits but within coastal limits or offshore limits must carry at least engine room watchkeepers specified in Table 6.
  • 1 from Maritime Rule 31.84(2)(a) – Crewing and Watchkeeping – Minimum crewing requirements for other ships – Minimum crew numbers holding certificates or prescribed endorsements.
  • 1 from Maritime Rule 32.10(1) – Seafarer Certification – Requirement to hold certificate and associated endorsements – No person may operate commercial ships, exercise privileges, or hold himself or herself out to be person entitled to exercise the privileges.
  • 1 from Maritime Rule 40A.9(4) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Construction – Pre-27 May 2004 ships – Compliance with Rule 40A.9(1).
  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.1, Fire crew outfits – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Fire-fighting appliances – Ships of less than 500 gross tonnage that undertake an international voyage – A ship must carry 2 fire crew outfits that comply with Rule 42B.66 and 2 sets of breathing apparatus that comply with Rule 42B.59.
  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.1, Non-portable foam and CO2 extinguishers – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Fire-fighting appliances – Provision of foam fire and CO2 fire extinguishers in a ship less than 350 gross tonnage.
  • 1 from Maritime Rule 40C.51(1), Appendix 2, 2.3, Fire crew outfits, (3)(a) – Design, Construction and Equipment – Passenger ships that are not SOLAS ships – Fire fighting appliances – Restricted coastal and restricted limit ships – Carriage of 1 fire crew outfit and 1 breathing apparatus.
  • 1 from Maritime Rule 40C.53(1), Appendix 4, 4.1, Satellite EPIRB – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Radiocommunications – Radiocommunication equipment – Ships within a VHF coverage area.
  • 1 from Maritime Rule 40C.72(1) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Construction – Watertight bulkheads – Barge must be fitted with a watertight collision bulkhead.
  • 1 from Maritime Rule 40C.80(b) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Radiocommunications – Must meet applicable requirements of Rule 40A.57.
  • 1 from Maritime Rule 40E.5 – Design, Construction and Equipment – Sailing ships – Design Approval.
  • 1 from Maritime Rule 40E.6 – Design, Construction and Equipment – Sailing ships – Construction standards.
  • 1 from Maritime Rule 40E.7(2)(a) – Design, Construction and Equipment – Sailing ships – Certification of constructions standards – Pre-10 April 201 ships – Compliance with Rule 40E.6(1) – Current certificate by classification society or authority and operating limits.
  • 1 from Maritime Rule 40E.7(2)(c) – Design, Construction and Equipment – Sailing ships – Certification of constructions standards – Pre-10 April 201 ships – Compliance with Rule 40E.6(1) – Undergone design approval and survey by surveyor.
  • 1 from Maritime Rule 42A.15(3)(b) – Safety Equipment – Life-Saving Appliances – Performance, Maintenance and Servicing – Survival craft and rescue boats – Non-SOLAS rescue boats must be fitted with a protective stowage cover and be capable of being righted by not more than two persons when inverted in water.
  • 2 from Maritime Rule 45.23(1) – Navigational Equipment – Magnetic compasses – Non-passenger ships and fishing ships of less than 6 metres in length that do not proceed beyond restricted limits.
  • 1 from Maritime Rule 45.23(2) – Navigational Equipment – Every magnetic compasses must have an appropriate table or curve of total errors available at all times.
  • 1 from Maritime Rule 51.100(2) – Crew Accommodation – Other spaces – Offices – Every ship of 3,000 tons gross tonnage or more must have one room for deck apartment and one room for engine department.
  • 1 from Maritime Rule 82, Appendix 1, 1.11.1 – Commercial Jet Boat Operations – River – Personal flotation devices must be correctly fitted on every passenger before boarding commercial jet boat.
  • 2 from Marine Protection Rule 122.8 – Marine Protection Products – Oil – Oil residue (sludge) tanks – Oil residue (sludge) tank piping.
