An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement.

The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 20 June 2016, the Register will be updated to record the easement as redundant.

Easement: Drainage right over Lot 2 DPS 88949 Certificate of Title SA70C/314 marked “A” on DPS 88949 (servient tenement) as appurtenant to Lot 1 DP 449459 Certificate of Title 578985 (dominant tenement) specified in Easement Certificate H360870.1 registered on 20 August 1981.

Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of the subdivision shown on DP 40450 and the easement no longer serves the dominant tenement.
