Under section 14(9) of the Dumping and Countervailing Duties Act 1988 (“Act”), anti-dumping duties imposed on wire nails from China will cease to apply to those goods on 2 June 2016, unless at that date the goods are subject to review under section 14(8) of the Act.

Any interested party that might request that the Chief Executive of the Ministry of Business, Innovation and Employment initiate a review before the cessation date referred to above should be aware that positive evidence justifying the need for a review must be provided to the chief executive.

Positive evidence justifying the need for a review would need to include reasons and evidence for believing that:

• the expiry of anti-dumping duties would see the continuation or recurrence of dumping of wire nails from China; and
• such dumping would likely cause the continuation or recurrence of material injury to the New Zealand industry producing wire nails.
