United Nations (Iran—Joint Comprehensive Plan of Action) (Incorporation by Reference) Notice 2016

This notice is issued pursuant to section 52(2)(d) of the Legislation Act 2012 and provides for notification of certain information concerning nuclear-related material, equipment or technology, ballistic missile-related technology and conventional arms incorporated by reference in the United Nations (Iran—Joint Comprehensive Plan of Action) Regulations 2016.

Notice

1. Title—This notice is the United Nations (Iran—Joint Comprehensive Plan of Action) (Incorporation by Reference) Notice 2016.

2. Interpretation—In this notice, unless the context requires otherwise:

the Regulations means the United Nations (Iran—Joint Comprehensive Plan of Action) Regulations 2016 made on 15 February 2016 and commenced on 19 February 2016.

3. Provisions incorporated in United Nations (Iran—Joint Comprehensive Plan of Action) Regulations 2016—The Regulations incorporated by reference information concerning certain nuclear-related material, equipment or technology, ballistic missile-related technology and conventional arms specified in the following documents:

  1. Guidelines for the Export of Nuclear Material, Equipment and Technology, dated 13 November 2013 [INFCIRC/254/Rev.12/Part 1];
  2. Guidelines for Transfers of Nuclear-related Dual-use Equipment, Materials, Software and Related Technology, dated 13 November 2013 [INFCIRC/254/Rev.9/Part 2];
  3. Missile Technology Control Regime – Equipment, Software and Technology List [S/2015/546]; and
  4. United Nations Register of Conventional Arms established by United Nations General Assembly resolution A/RES/46/36 L.

4. Availability of Material Incorporated—(1) Copies of the material that is incorporated in the Regulations described in clause 3 of this notice are available for inspection during working hours, free of charge, at the Ministry of Foreign Affairs and Trade located at 195 Lambton Quay, Wellington Central, Wellington.

(2) Copies of the material that is incorporated in the Regulations described in clause 3 of this notice can be purchased from the Ministry of Foreign Affairs and Trade, Private Bag 18901, Wellington 6160 (attention: Legal Division).

This note is for explanatory purposes only.

This notice provides for the notification of Regulations that contain provisions that incorporate by reference information concerning certain nuclear-related material, equipment or technology, ballistic missile-related technology and conventional arms.

Section 49 of the Legislation Act 2012 allows an instrument to incorporate by reference provisions that deal with technical matters that can reasonably be regarded as being too large or impractical to include in, or publish as part of, the instrument. The incorporated provisions form part of the Regulations for all purposes and have legal effect accordingly.
