Electricity Industry (Exemption No. 197 (Contact Energy Limited)) Exemption Notice 2014

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 197 (Contact Energy Limited)) Exemption Notice 2014.
(2) This notice comes into force on 18 April 2014.
2. Exemption-Contact Energy Limited ("Contact") is exempted from complying with the following clauses of the Electricity Industry Participation Code 2010 ("Code"):

Clause 11.7 Each trader must provide information about each installation control point ("ICP") at which they trade electricity, to the registry under Schedule 11.1
Clause 11.8A Each metering equipment provider ("MEP") must provide information to the registry for each metering installation for which it is responsible, in accordance with Schedule 11.4
Clause 11.15 The gaining trader and the losing trader must comply with Schedule 11.3 during the process for customer switching
Clause 11.15A Each gaining MEP, and each trader who notifies the registry of a gaining MEP, must comply with Schedule 11.4
Clause 9 of Schedule 11.1 Each trader must provide the listed information to the registry for each ICP for which it is recorded in the registry as having responsibility
Clause 10 of Schedule 11.1 Each trader must update the registry if information provided under clause 9 changes
Clause 11(2) of Schedule 11.1 The participant must change the information in the registry as soon as practicable after becoming aware of errors
Clause 12 of Schedule 11.1 Requirement to manage the status of an ICP, as recorded in the registry
Clause 17 of Schedule 11.1 Obligation to manage ICP status of "active"
Clause 19 of Schedule 11.1 Obligation to manage ICP status of "inactive"
Clauses 2-5,
9-12, 14-16 and 18(d)-(f) of Schedule 11.3 Obligations required as part of
the switching process - initiating, acknowledging, completing, responding
Clauses 1-3, 6 and 7 of Schedule 11.4 Metering equipment provider switching and registry metering records
Clause 15.4 Each reconciliation participant must deliver submission information
Clause 15.6 Each retailer must provide ICP days information to the reconciliation manager
3. Term-This exemption expires:
(a) in respect of the listed clauses in Part 11 of the Code, at the close of 23 May 2014;
(b) in respect of the listed clauses in Part 15 of the Code, at the close of 30 June 2014.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) Contact is implementing a major system upgrade that will temporarily affect its ability to comply
with some switching, registry management and submission processes within the timeframes specified in the Code;
(c) the exemption will permit Contact to shut down its existing legacy systems, migrate data, test, and manually correct errors occurring during the final cutover to the new system, without the potential interruption of managing multiple breach notices from other participants; and
(d) the exemption will have minimal impact on other participants and service providers, and will not affect any other Code provisions.
