Electricity Industry (Exemption No. 192 (Transpower New Zealand Limited)) Exemption Notice 2014

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 192 (Transpower
New Zealand Limited)) Exemption Notice 2014.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-Transpower New Zealand Limited, in its capacity as the system operator ("system operator"), is exempted from complying with the requirement in clause 13.62(1) of the Electricity Industry Participation Code 2010 ("Code") to prepare price-responsive and non-response schedules during a planned outage of the system operator's market system.
3. Term-(1) If the system operator's planned outage of the market system occurs on 12 April 2014, this exemption:
(a) commences on 12 April 2014; and
(b) expires at the earlier of:
(i) midnight on 12 April 2014; and
(ii) the return of the market system from the planned outage.
(2) If the system operator's planned outage of the market system occurs on 26 April 2014, this exemption:
(a) commences on 26 April 2014; and
(b) expires at the earlier of:
(i) midnight on 26 April 2014; and
(ii) the return of the market system from the planned outage.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) the exemption will only apply during a planned outage of the system operator's market system, which the system operator considers to be of high priority and importance;
(c) the system operator has planned the outage to minimise the impact on participants, and will work with participants in advance of the outage to ensure they are prepared;
(d) completing this outage will reduce the risk of future unplanned outages occurring;
(e) the planned outage and requested exemption will
not affect the calculation of final prices as the scheduling, pricing and dispatch software will still be able to access all the necessary input information, particularly the half-hour metering information at grid exit and injection points; and
(f) the requested exemption will only have a minor, temporary impact on market system participants or service providers, and will not affect any other Code provision.
