Electricity Industry (Exemption No. 161 (Contact Energy Limited)) Exemption Notice 2012

Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.

1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 161 (Contact Energy Limited)) Exemption Notice 2012.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-Contact Energy Limited ("Contact") is exempted from compliance with clause 10.3(b) of the Electricity Industry Participation Code 2010 ("Code") in respect of the following installation control points ("ICPs"):

3. Term-This exemption expires at the earlier of:
(a) the date on which the Electricity Industry Participation (Metering Arrangements) Code Amendment 2011 comes into force; and
(b) the date on which Contact no longer has the responsibility in the registry as the trader for the ICPs listed above.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) Contact would incur significant expenditure and complexity in fitting meters to each ICP where
the loads are predominantly street lights and
under-verandah lights with low annual consumption volumes (but over the 3,000 kWh level for unmetered load);
(b) the loads at these ICPs are static, have little annual variation, and changes can be accurately tracked;
(c) Contact has stated it will continue to treat the
loads as standard unmetered loads and record the information in the registry;
(d) the ICPs are likely to comply with the new Part
10 threshold (6,000 kWh per annum) for predictable unmetered load when the new Part 10 comes into force;
(e) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and
(f) granting the exemption meets the requirements of section 11(2) of the Act.
