Pursuant to section 11 of the Electricity Industry Act 2010 ("Act"), the Electricity Authority gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice is the Electricity Industry (Exemption No. 146 (TrustPower Limited)) Exemption Notice 2012.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption-(1) TrustPower Limited ("TrustPower") is exempted from compliance with clause 10.3(b) of the Electricity Industry Participation Code 2010 ("Code").
(2) This exemption only applies to installation control
points ("ICPs") 0007146030RN41C, 0007146031RN859, 0007146032RN499, 0007146034RN516, 0007146035RN953 and 0007146036RN593.
3. Term-This exemption expires on the earlier of:
(a) the date on which the six ICPs are all metered; and
(b) the date on which TrustPower no longer has the responsibility for the ICPs once they switch to another trader.
4. Reasons for granting the exemption-The reasons for granting this exemption are:
(a) Granting the exemption meets the requirements in section 11(2) of the Act for granting exemptions;
(b) the load is static and will have little annual variation. Most load changes can be accurately tracked;
(c) the exemption will have little or no impact on other participants and service providers, and will not affect any other Code provisions; and
(d) TrustPower has stated it will install meters at the ICPs once contracting resources are available.
