Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way easement.
The applicant claims the right of way easement is redundant by reason of the circumstances set out below.
I intend to remove the right of way easement on 3 August 2009 if no objections have been received before that date.

Applicant: Her Majesty The Queen for education purposes, c/o Crown Property Clearances, Land Information New Zealand, PO Box 5501, Wellington.
Easement: Right of way over Section 1 on SO 37347 (Computer Freehold Register 130929); marked “C” on DP 313257 appurtenant to Lot 2 DP 360644 (Computer Freehold Register 247567).
Circumstances: The dominant tenement has become physically separated from the servient tenement as a result of subdivision shown on DP 360644 and the easement no longer serves the dominant tenement.
