Notice of Decision to Recommend Making the Electricity Governance (Security of Supply) Amendment Regulations 2009 and Notice of Reasons for Decision

1. Pursuant to sections 172E(3)(b) and 172Z(4) of the Electricity Act 1992 (“the Act”), I notify my decision to recommend that the Governor-General make the Electricity Governance (Security of Supply) Amendment Regulations 2009 and the reasons for my decision.
Recommended Amendment to the Electricity Governance (Security of Supply) Regulations 2008
2. I decided to recommend to the Governor-General
that the Electricity Governance (Security of Supply) Amendment Regulations 2009 be made, as recommended by the Electricity Commission.
3. I made this recommendation pursuant to subpart 2 of Part 14 of the Act and in accordance with section 172E
of the Act.
4. The recommended amendments to the Electricity Governance (Security of Supply) Regulations 2008 will:
(a) require specified electricity industry participants to prepare Participant Outage Plans;
(b) provide for the enforcement of the regulations (with one exception) through the compliance regime under the Electricity Governance Regulations 2003 (as opposed to the courts); or
(c) make other minor and technical amendments.
Reason for Decision
5. The reason for my decision is that the recommended amendments will improve planning and implementation of contingency arrangements for the management of rolling outages.
