Electricity Governance Regulations (Exemption No. 106 (New Zealand Aluminium Smelters Limited)) Exemption Notice 2009

Pursuant to Regulation 194 of the Electricity Governance Regulations 2003, the Electricity Commission gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 106 (New Zealand Aluminium Smelters Limited)) Exemption Notice 2009.
(2) This notice comes into force on 17 September 2009.
2. Exemption—New Zealand Aluminium Smelters Limited (“NZAS”) is exempted from compliance with Rule 3.3 of Part D of the Electricity Governance Rules 2003.
3. Terms and conditions—This exemption is granted on the following conditions:
(a) This exemption expires at the close of 30 September 2014; and
(b) that NZAS remains responsible for the ICP at TWI2201 NZAS GN; and
(c) that there is a local network on the GXP TWI2201 that is reconciled by differencing.
4. Reasons for granting the exemption—The reasons for granting this exemption are:
(a) it would be an unnecessary cost for NZAS to provide a metering installation on its ICP on TWI2201 NZAS GN;
(b) NZAS is the only consumer on TWI2201 NZAS GN and, as such, is responsible for payment for the total volume conveyed through the GXP TWI2201 to the local network; and
(c) as NZAS is the only consumer on TWI2201 NZAS GN, no other consumers will be affected.
