Amendment to Transit New Zealand Bylaw 2005/7* Maximum Speeds of Vehicles on State Highways

Pursuant to section 61(3) of the Government Roading Powers Act 1989, and Land Transport Rule: Setting of Speed Limits 2003, the New Zealand Transport Agency hereby makes the following bylaw.
A m e n d m e n t
1. Title and commencement—This bylaw may be cited
as the New Zealand Transport Agency (Maximum Speeds
of Vehicles on State Highways) Amendment Bylaw
2009/4 and will come into force 28 days after the date of publication of this notice in the New Zealand Gazette.
2. Amendments—The Transit New Zealand (Maximum Speeds of Vehicle on State Highways) Bylaw 2005/7* is hereby amended by:
(a) Adding the following paragraph to Clause 4
“(c) The sections of road described in Schedule 1, Part
C are school zones which are subject to a variable
speed limit of 40 km/h when the numerals “40” are displayed on the variable speed limit signs. At all other times, the speed limit is the permanent speed limit for the road. The variable speed limit signs may indicate a speed limit of 40 km/h during the following times on school days:
? 35 minutes before the start of school until the start of school
? 20 minutes at the end of school commencing no earlier than five minutes before the end of school
? 10 minutes at any other time of day when at least 50 children cross the road or enter or leave vehicles at the roadside.”
(b) Adding the following to Schedule 1:
“Part C
(a) The section of State Highway No. 23 (Massey Street) in Hamilton City, from a point 40 metres west of Campbell Street to a point 50 metres west of Rifle Range Road: a distance of approximately 400 metres.
(b) The section of State Highway No. 26 (Morrinsville Road) in Hamilton City, from a point 105
metres north-east of Cambridge Road to a point
20 metres south-west of Berkley Avenue: a distance of approximately 290 metres.
(c) The section of State Highway No. 39 (Horotiu Road) at Te Kowhai, from a point 30 metres south of
Te Kowhai Road to a point 90 metres north
of Bedford Road: a distance of approximately 230 metres.”
(c) Replacing line 173(a) in Schedule 3 to read:
