Notice of Making of Electricity Governance Amendment Rules (No. 61) 2008 and Notice of Reasons for Decision

1. Pursuant to section 172I of the Electricity Act 1992 (“Act”), I notify the amendment of the Electricity Governance Rules 2003 (“Rules”) under section 172H of the Act.
2. The empowering provisions for the electricity governance regulations in relation to which the amendments to the Rules are made are sections 172D(1)(3) and 172D(1)(4) of the Act.
3. A brief description of the nature of the amendments is
as follows:
(a) Asset owners are required to carry out routine testing of their grid connected assets in accordance with Technical Code A of Schedule C3 of Part C of the Rules; and
(b) a new Appendix B is added to Technical Code A of Schedule C3 of Part C of the Rules, setting out the mandatory testing requirements to be followed by asset owners.
4. Pursuant to section 172Z(4) of the Act, the reason for
my decision to amend the Rules is to ensure that asset owners meet their asset owner performance obligations by verifying:
(a) the accuracy of data they supply to the system operator in asset capability statements; and
(b) that assets are capable of being operated within the limits stated in asset capability statements.
5. These Rules come into force on 5 June 2008.
