Companies Act 1955
The following company was reinstated to the Register of Companies on 26 March 2007:
Taranaki Mortgage Investments Limited (in liquidation). 172124.
It had been removed on the incorrect grounds that no liquidator was acting and then restored under section 328 of the Companies Act 1993 that did not apply to it, as the liquidation had commenced under the Companies Act 1955 on
13 September 1989.
The procedures for removal and restoration were null and void (refer Re Crott’s Application (1991) 5 NZCLC 67,325) and it is proper that the Register be corrected.
