Local Government (Auckland City) Boundary Alteration Notice 2005

Pursuant to clause 5 (1) of Schedule 2 to the Local Government Act 2002, the Minister of Local Government gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice is the Local Government Boundary Alteration (Auckland City) Notice 2005.
(2) This notice comes into force on the day after it is published in the New Zealand Gazette.
2. Boundaries of Auckland City—(1) Subject to subclause (2) of this clause, the seaward boundaries of Auckland City
are extended to the mean low water springs.
(2) The seaward boundaries of Auckland City in the areas listed in Schedule 1 to this notice are as described in that Schedule.
(3) For the avoidance of doubt, the area described in Schedule 2 forms part of Auckland City.
3. Application to existing boundaries—(1) Nothing in this notice has the effect of excluding from Auckland City any area included in that city before this notice is in force.
(2) Without limiting the application of subclause (1) of this clause, the following areas remain in Auckland City:
Hobson Bay;
The Orakei Basin;
The Panmure Basin; and
The Viaduct Basin.
4. Wards—The areas included in Auckland City by this notice are included in the adjacent ward of Auckland City.
5. Communities—The areas included in Auckland City by this notice are included in the adjacent community of Auckland City.
6. Boundaries of adjacent territorial authority districts—Unless the circumstances otherwise require, wherever the boundaries of Auckland City meet the boundary of another territorial authority district at the mean high water mark,
the boundary of the district extends from that point along a line running at 90 degrees from the line of the mean high water mark to the point where the boundary meets the line of the mean low water springs.
Schedule 1
Area Boundary
Whau River The middle line of the river following its natural course from the source of that river to the seaward side of the North Western Motorway, then proceeding in an easterly direction along the seaward side of the motorway to mean low water springs.
Westhaven Marina A line commencing at the easternmost point of Lot 21, DP 133386 and proceeding easterly to the northernmost point of a breakwater, being Lot 11, DP 133386, thence following the line of mean low water springs along the northern sideof that breakwater to its easternmost point, thence to the westernmost corner of Lot 1, DP 34256.
Those wharves and other structures joined to wharves situated between the eastern side of Westhaven Marina and the easternmost corner of Lot 1, DP 131562 (as depicted on SO 63510) The seaward edge of those wharves and other structures, but crossing the entrance to the Viaduct Basin between the Halsey Street Wharf and Hobson Wharf.
Tamaki River The middle line of the river following its natural course from the intersectionof that river with the south-eastern corner of Section 36, SO 42779, to the point between West Tamaki Head and Musick Point where the river meets the sea.
Mangere Inlet A line commencing at the intersection of the southern boundary of Auckland City with the mean high water mark in the Mangere Inlet, then following a line between the following coordinates listed below:A 6472875mN2666700mEB 6472670mN2670000mEC 6472370mN2672600mED 6472310mN2672670mEthen proceeding in a generally westerly direction following the middle lineof the Wairopa Channel, then following the northern arm of that channel(north of Motukaraka Bank) to its intersection with a line being the projectionof the western boundary of Allotment 727, Parish of Waikomiti, SO 53502,then following that line in a generally northerly direction to the south western corner of Allotment 27.
Schedule 2
All that area bounded in the north by Traherne Island and the North Western Motorway, in the east by the suburb Waterview, and in the south-west by the Avondale Peninsula.
