Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003—Rule Amendment Proposal No. 65

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 (“Rules”), Rule Amendment Proposal No. 65, is issued by the Electricity Commission (“Commission”), established under the Electricity Act 1992 (“Act”), pursuant to section 172E (2) (c) of that Act.
Section 172E (2) (c) provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy (“Minister”), the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.
Recommendation
The Commission made a recommendation to the Minister on 19 May 2005 that Rule 2.1.5.1 of Section II of Part F of the Rules be amended.
The Commission further recommended that minor changes to the definitions of “Board” and “transmission pricing methodology” in Part A of the Rules be made, in reliance on section 172F (3).
Section 172F (3) provides that the Commission is not required to comply with section 172F (1) (which relates to carrying out an assessment) if it is satisfied that the effect
of the recommendation is minor and will not adversely affect the interests of any person in a substantial way.
In reliance on section 172F (3), no such assessment has been carried out under section 172F (1) of the Act, for the recommended minor amendments to Part A.
Recommended Amendments to the Rules
The recommended amendment to Rule 2.1.5.1 of Section II of Part F would provide the Minister with the discretion to allow the Commission a longer period than 20 business days in which to complete its consideration of submissions relating to the structure of transmission agreements.
The first recommended amendment to Part A would change the definition of “Board” to reflect the Commission’s change of name from the “Electricity Governance Board” to the “Electricity Commission”.
The second recommended amendment to Part A would change the definition of “transmission pricing methodology” to correct a typographical error.
At present, the definition incorrectly refers to Section V of Part F and should instead refer to Section IV of Part F.
