Notice of Making of a Recommendation and Assessment Concerning the Electricity Governance Rules 2003 – Electricity Governance Amendment Rules (No. 10) 2004

This notice of a recommendation and assessment concerning the Electricity Governance Rules 2003 (“Rules”), in particular Electricity Governance Amendment Rules (No. 10)
2004 (“Amendment Rules”), is issued by the Electricity Commission (“Commission”), established under the Electricity Act 1992 (“Act”), pursuant to section 172E (3) (a) (iii) of that Act.
Section 172E (3) (a) (iii) provides that, no later than
10 working days after making a recommendation concerning the Rules to the Minister of Energy (“Minister”), the Commission must publicise the recommendation and
the assessment completed under section 172F of the Act.
Recommendation
The Commission made a recommendation to the Minister on 12 April 2005 that the Amendment Rules, which were made under urgency in reliance on section 172E (3) of the Act on 4 November 2004, should not be revoked, replaced or amended.
Recommended Amendment to the Rules
The Amendment Rules amended Rule 5.3 of Section IV of Part F to provide the Minister with the discretion to allow the Commission a longer period than 20 business days in which to complete its consideration of submissions on the transmission pricing methodology process and guidelines issues paper.
