Making of a Recommendation Concerning the Electricity Governance Rules 2003 - Rule Amendment Proposal No. 10

This notice of a recommendation concerning the Electricity Governance Rules 2003 ("Rules"), rule amendment
proposal No. 10, is issued by the Electricity Commission ("Commission"), established under the Electricity Act 1992 ("Act"), pursuant to section 172E (2) (c) of that Act.
Section 172E (2) (c) provides that, no later than 10 working days after making a recommendation concerning the Rules to the Minister of Energy ("Minister"), the Commission must publicise the recommendation and the assessment completed under section 172F of the Act.
Recommendation
The Commission made a recommendation that rule 5.3 of section IV of Part F of the Rules be amended, in reliance
on section 172E (3) of the Act (urgency), on 28 October 2004.
Section 172E (3) provides that section 172E (2) (b)
and section 172F (which relate to consultation and assessments) do not apply if the Commission considers
that it is necessary or desirable in the public interest that
the proposed rules be made urgently.
Instead, consultation and the assessment must be carried out within six months of the rule being made.
Accordingly no such assessment has been carried out at this stage.
Recommended Amendment to the Rules
The recommended amendment to the Rules was the insertion of the words "(or such longer period as
the Minister may allow)" after the words "expiry date" in rule 5.3 of section IV of Part F, for the Minister to allow a longer period than 20 business days in which the Commission's Board must complete its consideration of all submissions it receives on the transmission pricing methodology process and guidelines issues paper.
A copy of the Commission's recommendation is available, at no cost, on the Commission's web site:

Dated at Wellington this 29th day of October 2004.
