Fisheries (Kaimoana Customary Fishing) Notice (No. 12) 2003 (No. F247)

Pursuant to Regulation 9 (2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, a senior fisheries management advisor, Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988), hereby gives the following notice.
N o t i c e
1. Title and commencement-(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 12) 2003.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.
2. Interpretation-In this notice:
(a) "Kaitiaki" is a local dialect word that has the same meaning as "Tangata Kaitiaki/Tiaki", a term that is defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(b) Any reference to "Kaitiaki" means the person or persons appointed under Regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 as Tangata Kaitiaki/Tiaki for customary food gathering within the area/rohe moana and confirmed in clause 3 of this notice.
(c) Any reference to "area/rohe moana" means one of those areas described in clause 3 of this notice.
3. Appointment of Kaitiaki-The Associate Minister of Fisheries (acting pursuant to a delegated authority) hereby confirms the appointment of:
(a) Henry James Power to manage customary food gathering within the area/rohe moana described by a line beginning on the coastline at Poroporo (40 27.0ó S and 176 37.5ó E), then east to the
12 nautical mile limit to reference point (40 27.0ó S and 176 53.0ó E), then south west along the 12 nautical mile limit to reference point (40 52.0ó S and 176 30.5ó E), then west to Mataikona (40 47.0ó S and 176 16.0ó E) and then north east following the coastline to the point of commencement; and
(b) William Wright to manage customary food gathering within the area/rohe moana described by a line beginning on the coastline at Poroporo (40 27.0ó S and 176 37.5ó E), then east to the 12 nautical
mile limit to reference point (40 27.0ó S and 176 53.0ó E), then south west along the 12 nautical mile limit to reference point (40 47.5ó S and 176 24.5ó E), then north-west to Owahanga (40 41.0ó S and 176 21.5ó E) and then north east following the coastline to the point of commencement; and
(c) Matai Hamuera Broughton to manage customary food gathering in the area described by a line beginning on the coastline at Owahanga (40 41.0ó S and 176 21.5ó E), then perpendicular to the coastline out to the 12 nautical mile limit (40 47.5ó S and 176 24.5ó E), then south along the 12 nautical mile limit to reference point (40 57.5ó S and 176 29.9ó E), then west towards Whareama to the coastline (40 57.5ó S and 176 09.0ó E) and then north east following the coastline to the point of commencement; and
(d) Pikihuia Monica Wilton to manage customary food gathering in the area described by a line beginning on the coastline at Mataikona (40 47.0ó S and 176 16.0ó E), then perpendicular to the coastline out to the 12 nautical mile limit (40 52.0ó S and 176 30.5ó E), then south along the 12 nautical
mile limit to reference point (40 57.5ó S and 176 29.9ó E), then west towards Whareama to the coastline (40 57.5ó S and 176 09.0ó E) and then north-east following the coastline to the point of commencement.
4. Confirmation of tangata whenua-Te Hika o Papauma is confirmed as the tangata whenua of the area/rohe moana to which the appointment of the Kaitiaki relates.
5. Power to authorise taking of fisheries resources for customary food gathering-The Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those fisheries resources that are taken in fresh water, for customary food gathering purposes from within the whole or any part of the area/rohe moana for which they have been appointed as Kaitiaki.
No customary food gathering of fisheries resources may take place in the area/rohe moana without authorisation from the Kaitiaki.
