Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Stephen Robert Gilbert, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the First Schedule to this notice is hereby acquired for drainage purposes and vested in the Western Bay of Plenty District Council on the date of publication of this notice in the New Zealand Gazette, subject to the land covenant described in the Second Schedule to this notice.

Land Covenant
The Western Bay of Plenty District Council and its successors in title must not plant or permit to be planted on the land any trees or shrubs without first consulting with the registered proprietors of the balance of the land in certificate of title 66D/359, and must not erect or place any buildings or structures on the land or grow or permit to grow on the land any trees, shrubs or other growing things which impede the sight corridor from the northern end of the Talisman Hotel and the Landing Café to the river. This covenant is intended to run with the land for the balance of the land in certificate of title 66D/359.
