Care Supplement Amendment 2002

Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister of Social Services and Employment establishes and approves the following Amendment to the Care Supplement Programme established and approved on 22 June 1999.

A m e n d m e n t
1. Title-(1) This amendment is the Care Supplement Amendment 2002.
(2) In this amendment, the Care Supplement Programme is called "the programme".
2. Commencement-This amendment comes into effect on 1 July 2002.
3. Purpose-Clause 2.1 of the programme is amended by omitting the words "the Director-General's".
4. Definitions-(1) Clause 3.1 of the programme is amended by inserting, after the definition of care supplement, the following definition:
"child has the meaning in section 3 (1) of the Act"
(2) The definition in clause 3.1 of the programme of foster parent is amended by omitting the words "by the
Director-General".
(3) Clause 3.2 of the programme is amended by inserting, after the word "Act", the words "or section 2 of the CYPF Act".
5. Care supplement-Clause 5.1 (a) of the programme is amended by revoking subparagraph (iii), and substituting the following subparagraph:
"(iii) under the CYPF Act, was discharged at any time into the care of the former foster parent from the custody or guardianship of-
(a) a Cultural Social Service; or
(b) the Director of a Child and Family Support Service; or
(c) an Iwi Social Service; or
(c) the Director-General; and"
6. Beginning and ending of care supplement-Clause 7 of the programme is amended by inserting, after subclause 7.1, the following subclause:
"7.1A If an application for it is received on or before 30 June 2003, a care supplement begins on 1 July 2002 if the former foster parent-
(a) was receiving an orphan's benefit or an unsupported child's benefit for the child on 1 July 2002; and
(b) was not eligible to receive the supplement under the former clause 5.1 (a) (iii) in effect prior to that date."
7. Revocation-The Care Supplement Amendment approved on 24 October 1999 is revoked.

Explanatory Note
This note is not part of the amendment, but is intended to indicate its general effect.
This amendment extends eligibility to receive a care supplement to former foster parents to whom a child was discharged into care by an Iwi Social Service, a Cultural Social Service or the Director of a Child and Family Support Service under the Children, Young Persons, and Their Families Act 1989, and removes the date limitation imposed in October 1999.
