Quota Allocation Systems Review and Subsequent Amendment

The New Zealand Meat Board has completed its review of its existing Quota Allocation Systems (as required by section
31 (2) of the Meat Board Act 1997), being European Union Sheepmeat and Goatmeat Tariff Rate Quota; European Union High Quality Beef Tariff Rate Quota; United States Beef and Veal Tariff Rate Quota; and United States Lamb Tariff Rate Quota.
The board has agreed that the existing allocation systems will remain in operation subject to the following amendments:
European Union Sheepmeat and Goatmeat Tariff Rate Quota; European Union High Quality Beef Tariff Rate Quota; United States Beef and Veal Tariff Rate Quota:
(a) In the European Union Sheepmeat and Goatmeat Tariff Rate Quota, "Qualifying Product" is being amended to mean sheepmeat and goatmeat slaughtered in a European Union listed slaughterhouse for ovine/caprine meat as appropriate, measured as dressed carcass hot weight;
(b) In the United States Beef and Veal Tariff Rate Quota, "Qualifying Product" is being amended to mean slaughtered at USDA Listed Premises and measured as the dressed carcass hot weight;
(c) In the European Union High Quality Beef Tariff Rate Quota, the term "processed through" is being replaced with "slaughtered in" in the definition of Qualifying Product;
(d) References to the carcass classification system that imply that utilisation of it is mandatory are being amended;
(e) The New Entrant definitions in all 3 quota manuals are being amended to allow a company to reapply as a first year New Entrant in the following year if it has returned all of its conditional Reserved Quota Allowance to the board in good time;
(f) The European Union High Quality Beef Tariff Rate Quota New Entrant definition is being amended to bring it into line with the New Entrant definitions in the quota manuals for the European Union Sheepmeat and Goatmeat and United States Beef and Veal Tariff Rate Quotas by amending the reference to a related company's shareholder interest to 25% or more and amending the reference to beneficial shareholders to 25% or more;
(g) The penalty for under-utilisation of European Union Sheepmeat and Goatmeat Tariff Rate Quota allocated in the 2000 Quota Year and beyond will be 2-times the under-utilisation less the tolerance level;
United States Lamb Tariff Rate Quota:
(h) The date that holders of General Quota Allowance are to advise the board if they will not use any portion of their General Quota Allowance is changed to 1 May (previously 1 April);
(i) The initial allocation of Reserved Quota Allowance is limited to a maximum of 30 tonnes for each New Entrant;
(j) The New Entrant definition is being amended to bring the requirements for a related company into line with those for the applicant company, that is, there will be reference to the company's record as an exporter rather than to its record of having been allocated Quota Rights or quota allowance;
(k) Section 10, part B is being amended to include unused Reserved Quota Allowance;
All Allocation Systems:
(l) Reference is being made to the additional member of the New Entrant Allowances Committee.
All amendments come into effect as at 1 October 2000.
Copies of the manuals for the allocation systems are available from the board.
