Road Realignment State Highway No. 1, Glengarry Elands Realignment, Hastings District Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland: (a) Pursuant to section 114 (1), declares the land described in the First Schedule to this notice to be road which pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 5 and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette. (b) Declares the land in the Second Schedule to this notice to be taken under section 119 (1) and the land firstly described shall be amalgamated with the land in certificate of title W1/371. (c) Pursuant to sections 116 (1), 117 (1) and 120 (3): (i) declares the portions of road described in the Third Schedule to this notice to be stopped (now known as Sections 12, 14, 10, 13, 15, 16 and 17, S.O. 10746 respectively) and vested in William Ross Bramwell, sheepfarmer of Argyll, Waipawa (1/2 share), Thelma Joy Kerr, married woman of Havelock North (1/4 share) and Pamela Dawn Gwillim, married woman of Rotorua (1/4 share) as tenants in common in the said shares, subject to mortgage 336641.8 and subject to the restriction in the Seventh Schedule to this notice. (ii) declares the portions of road described in the Fourth Schedule to this notice to be stopped (now known as Section 9, S.O. 10746) and amalgamated with the land in certificate of title W1/371. (iii) declares the portions of road described in the Fifth Schedule to this notice to be stopped (now known as Section 11, S.O. 10746). (d) Pursuant to section 28, a right of way easement in gross on the terms and conditions set out in the Seventh Schedule to the Land Transfer Act 1952, modified as set out in the Eighth Schedule to this notice is acquired and vested in the Crown over: (i) the land firstly described in the Third Schedule to this notice marked ``E1'' on S.O. 10746. Seventh Schedule No person shall plant any tree or erect any structure on the land which could shade the pavement of State Highway No. 5, adjoining the land between the hours of 8.00 a.m. and 4.00 p.m. at any time of year. This restriction shall not apply to normal post and wire stock and deer fences. Eighth Schedule 1. The right shall be exercised on behalf of the Crown by employees and contractors of Transit New Zealand or any local authority that has responsibility for State Highway No. 5 for the purposes only of access to the maintenance of the culverts and rock-rip structure associated with State Highway No. 5. 2. The Crown shall carry out any remedial work to the access area that is required as a result of slipping of the roadside batters and the owner shall graze the easement area including the roadside batters in such a manner that a reasonable grass cover is maintained at all times to minimise the risk of the batters slipping.
