Stormwater Easement in Gross Acquired for Drainage Purposes, Kotuku Drive, Kapiti Coast Pursuant to section 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that pursuant to an agreement to that effect having been entered into, an easement in gross is acquired over the land described in the Schedule to this notice, (referred to as ``the land'') by the Kapiti Coast District Council. The easement shall be subject to the following terms, conditions, covenants and restrictions. (i) The Kapiti Coast District Council, its employees or contractors may carry out maintenance works including reshaping the land to maintain the soakage area on the land. (ii) The Kapiti Coast District Council shall have the right to discharge untreated urbanised stormwater run off from stages 1 and 2 of Kotuku Park subdivision into the soakage area on the land. (iii) Before effecting any entry under this right the Kapiti Coast District Council shall consult with the Crown concerning any proposed works and after the works are completed the Kapiti Coast District Council shall reinstate the disturbed area to its former state including replanting with vegetation species approved by the Crown.
