Local Government (Clutha District and Southland District) Boundary Alteration Notice 1999 Pursuant to section 37p (2) (b) of the Local Government Act 1974, the Minister of Local Government gives the following notice: N o t i c e 1. Title This notice may be cited as the Local Government (Clutha District and Southland District) Boundary Alteration Notice 1999. District Boundaries 2. Boundary alteration The boundaries of Clutha District and Southland District are altered by excluding the area described in Schedule 1 from Clutha District and including it in Southland District. 3. Seaward boundary For the avoidance of doubt it is declared that the seaward boundary of the area included in the Southland District by this notice shall be in the line of mean low water springs. 4. Wards The area described in Schedule 1 ceases to form part of the Catlins Ward of Clutha District and forms part of the Toetoes Ward of Southland District. Regional Boundaries 5. Regional boundaries For the purpose of clarity it is noted that (a) Section 37o (3) of the Local Government Act 1974 provides that ``where the boundaries of a district that are the same as the boundaries of any part of a region are altered, the alteration shall have effect with respect to the region, and the boundaries of the region shall be deemed to be altered accordingly''; and (b) In accordance with section 37o (3), the areas included in Southland District by this notice cease to form part of the Otago Region and form part of the Southland Region. 6. Seaward boundaries of regions The boundary between the Otago Region and the Southland Region between mean low water springs and the outer limit of the territorial sea shall be a line commencing at a point on the line of mean low water springs 120 degrees south of the north-eastern corner of Section 14, Block XIII, Tautuku Survey District, Southland Land District and proceeding along the projection of that line to the outer limit of the territorial sea. 7. Regional constituencies The areas excluded from the Otago Region by this notice and included in the Southland Region cease to form part of the Molyneaux Constituency of the Otago Region and form part of the Hokonui Constituency of the Southland Region. Transitional Matters 8. General Subject to clauses 9 and 10, Part II of Schedule 3b to the Local Government Act 1974 apply to this notice as if it were an Order in Council giving affect to a reorganisation scheme prepared under that Act. 9. Territorial authorities (1) The local civil defence plan prepared by the Clutha District Council under section 34 of the Civil Defence Act 1983 ceases to apply to the areas excluded from the Clutha District by this notice. (2) The local civil defence plan prepared by the Southland District Council under section 34 of the Civil Defence Act 1983 applies to the areas included in the Southland District by this notice. (3) For the purposes of clarity it is noted that the provisions of section 81 of the Resource Management Act 1991 apply to the administration of plans prepared under that Act by the Clutha District Council and the Southland District Council. 10. Regional councils (1) The documents prepared by the Otago Regional Council and listed in Schedule 2 cease to apply to the areas excluded from the Otago Region by this notice. (2) The documents prepared by the Southland Regional Council and listed in Schedule 2 apply to the areas included in the Southland Region by this notice. (3) For the purposes of clarity it is noted that the provisions of section 81 of the Resource Management Act 1991 apply to the administration of plans prepared under that Act by the Otago Regional Council and the Southland Regional Council. General Provisions 9. Revocation The Local Government Boundary Alteration Notice 1999 is revoked. Schedule 1 Area Excluded From Clutha District and Included in Southland District All that area bounded by a line commencing at a 404 metre spot height situated at Grid Reference 182984 (NZMS 260 G47), thence in a generally south easterly direction along the watershed separating Alison Creek and Longbeach Creek to the north west corner of part Section 57, Block XII, Tautuku Survey District, thence generally easterly and south easterly along the northern and the north east boundary of the said part Section 57, and the north east boundaries of part Section 17, part Section 16 and part Section 15, Block XII, Tautuku Survey District to the north east corner of the said part Section 15, thence in a generally southerly direction along the eastern boundary of the said part Section 15 and Section 45, Block XII, Tautuku Survey District and a projection of the said line across the Chaslands Highway to the northern boundary of Section 18, Block XIII, Tautuku Survey District, thence in a generally south easterly, southerly and south westerly direction along the northern, eastern and south eastern boundaries of the said Section 18 to the north eastern boundary of part Section 16, Block XIII, Tautuku Survey District, thence in a generally south westerly and south easterly direction along the north eastern boundaries of the said Section 16 and Section 12, Block XIII, Tautuku Survey District to the eastern most point of the said Section 12, thence in a generally south westerly direction along the south western boundary of the said Section 12 and a projection of the said line across a legal road to the northern boundary of Section 11, Block XIII, Tautuku Survey District, thence in a generally south easterly direction along the north eastern boundary of the said Section 11, the north eastern boundaries of the two southernmost portions of Section 13, Block XIII, Tautuku Survey District, crossing a legal road, and the north eastern boundary of the southernmost portion of Section 14, Block XIII, Tautuku Survey District, and a projection of the said line across a legal road to the mean low water springs mark of the sea, thence generally south westerly and northerly along the southern and western boundaries of the Clutha District as defined on S.O. Plan 23137 (Otago Land District) to the point of commencement.
