Dilworth Trust Board Notice of Application for Approval of a Scheme In the High Court of New Zealand, Auckland Registry M. No. 711-IM/99 In the matter of the Charitable Trusts Act 1957, and in the matter of the Dilworth Trustees Act 1967 and in the matter of the Dilworth Trust Board being a board of trustees incorporated under the Charitable Trusts Act 1957: Notice is hereby given that on Friday, the 11th day of June 1999 at 10.30 a.m., or so soon thereafter as counsel can be heard, the application by the Dilworth Trust Board for approval of a scheme prepared by it, to extend and vary the powers of the Dilworth trustees and to vary the mode of administration of the assets of the Dilworth Trust Board, will be heard in the High Court at Auckland. The trustees and their advisers have undertaken a comprehensive review of the provisions of the will of James Dilworth as varied by subsequent Acts and schemes. They have prepared this scheme to extend, clarify or vary the trusts in various respects appropriate to modern conditions, but at the same time endeavouring to disturb James Dilworth's wishes only to the minimum. The scheme proposes to extend, clarify or vary the trusts in respect of the following matters: (1) Enrolment of pupils (age for selection, residential qualification, Ulster boys, review of eligibility for admission to the school); (2) Declaration of faith (to be required only from the chaplain, and the trustees); (3) Supervision of former pupils; (4) Trustees (filling vacancy in number); (5) Secretary and audit; (6) Audited accounts available to visitor to institute; (7) Visitor to institute; (8) Gifts to the board; and (9) Study to investigate feasibility of possible facilities for girls. A copy of the full text of the scheme, and also a copy of the Attorney-General's report on the scheme, may be obtained on application to the solicitors named below, or inspected at their offices, without payment of any fee. Any person desiring to oppose the scheme must, not less than 7 clear days before the date of hearing, give written notice of his/her intention to do so to the Registrar of the High Court at Auckland, to the Attorney-General at Wellington, and to the Dilworth Trust Board.
