The Fisheries (Southern Scallop Fishery Rotational Fishing) Notice 1998 (No. F94) Pursuant to section 28zzf (2) of the Fisheries Act 1983 and acting pursuant to delegated authority in accordance with section 41 of the State Sector Act 1988, the Policy Manager, Ministry of Fisheries hereby makes the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Fisheries (Southern Scallop Fishery Rotational Fishing) Notice 1998. (2) This notice shall come into effect the day after its notification in the New Zealand Gazette. 2. Interpretation In this notice any reference to the Southern Scallop Fishery means the Quota Management Area SCA7 Southern Scallop Fishery described in Part III of the First Schedule to the Fisheries Act 1996. 3. Rotational Fishing Areas No commercial fisherman shall take scallops from the following defined areas within the waters of the Southern Scallop Fishery. (a) Area C Those waters of Golden Bay enclosed by straight lines drawn from Taupo Point at approximately 40 47.4 S and 172 57.3 E to Bush End Point Light, Farewell Spit at approximately 40 32.9 S and 173 00.6 E to Patons Rock at approximately 40 47.3S and 172 45.8 E and then in a generally south-easterly direction back along the mean high water mark to the point of commencement at Taupo Point at approximately 40 47.4 S and 172 57.3 E. Except that scallops may be taken from Area C in that area enclosed by straight lines commencing at a point at 40 44.39 S and 172 48.92 E to a point at 40 45.62 S and 172 51.09 E to a point at 40 47.05 S and 172 50.07 E to a point at 40 45.91 S and 172 47.37 E and then back to the point of commencement at 40 44.39 S and 172 48.92 E. (b) Area D, E and F: Those waters enclosed by a straight line commencing near Totaranui at approximately 40 49.0 S and 173 00.9 E to the outer edge of Separation Point Coral Patch at approximately 40 47.7 S and 173 07.7 E to a point in mid Tasman Bay at 41 02.8 S and 173 16.1 E to the eastern end of Rabbit Island at approximately 41 17.1 S and 173 11.8 E to Mapua at approximately 41 14.9 S and 173 06.2 E and then in a generally northerly direction back along the mean high water mark to the point of commencement near Totaranui at approximately 40 49.0 S and 173 00.9 E. Except that scallops may be taken from Area E in that area enclosed by straight lines commencing at a point at 41 01.00 S and 173 04.50 E to a point at 41 06.50 S and 173 04.50 E to a point at 41 06.50 S and 173 06.34 E to a point at 41 06.44 S and 173 06.50. E to a point at 41 01.00 S and 173 06.50. E and then back to the point of commencement at 41 01.00 S and 173 04.50 E. And except that scallops may be taken from Area F in that area enclosed by straight lines commencing at a point at 41 06.67 S and 173 08.85 E to a point at 41 07.56 S and 173 10.41 E to a point at 41 08.50 S and 173 11.90 E to a point at 41 09.22 S and 173 11.09. E to a point at 41 08.30 S and 173 09.59. E to a point at 41 07.39 S and 173 08.03. E and then back to the point of commencement at 41 06.67 S and 173 08.85 E. 4. Cancellation of Previous Notice The Fisheries (Southern Scallop Fishery Rotational Fishing) Notice (No. 2) 1997 (No. F67) published in the New Zealand Gazette on the 11th of September 1997, No. 124, at page 2929 is hereby cancelled.
