Road Realignment State Highway No. 5, Earthquake Flat Rotorua District Pursuant to Part VIII of the Public Works Act 1981, the Minister of Lands: (a) Pursuant to section 114, declares the land described in the First Schedule hereto, to be road which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of State Highway No. 5 which shall vest in the Crown. (b) Pursuant to section 119, the land described in the Second Schedule to be taken, and further declares: (i) The area marked ``J'', now known as Section 1, S.O. 60714, shall be amalgamated with the land in certificate of title 56C/234. (ii) The areas marked ``M'', ``N'' and ``O'', now known as Sections 4, 5 and 6, S.O. 60714 respectively, shall be amalgamated with the land in certificate of title 22A/1371, subject to mortgage H. 758053.1 and H. 419490.3. (c) Pursuant to sections 116 and 117, the portion of road described in the Second Schedule to be stopped, and further declares: (i) The area marked ``K'', now known as Section 2, S.O. 60714, shall be amalgamated with the land in certificate of title 56C/234. (ii) The areas marked ``L'' and ``P'', now known as Sections 3 and 7, S.O. 60714, respectively, shall be amalgamated with the land in certificate of title 22A/1371, subject to mortgage H. 758053.1 and H. 419490.3.
