The Fisheries (Declaration of Species as Spat) Notice (No. 2) 1993 (No. 5317) Pursuant to section 2 (1) of the Fisheries Act 1983, the Director (Operations) of MAF Fisheries, acting pursuant to delegated authority, hereby gives the following notice: N o t i c e 1. Title and commencement (1) This notice may be cited as the Fisheries (Declaration of Species as Spat) Notice (No. 2) 1993. (2) This notice shall come into effect on the day after the date of its notification in the Gazette. 2. Interpretation In this notice: (a) The term ``test diameter'' means the diameter of the hard outer covering of an organism (b) The following species definitions shall apply ``Bladder kelp'' means the seaweed Macrocystis pyrifera. ``Blue mussel'' means the mollusc Mytilus galloprovincialis (formerly known as Mytilus edulis aoteanus). ``Bull kelp'' means the seaweed Durvillaea spp. ``Cockle'' means the mollusc Austrovenus stutchburyi (formerly known as Chione stutchburyi). ``Dredge oyster'' means the mollusc Tiostrea chilensis. ``Green-lipped mussel'' or ``Greenshell mussel'' means the mollusc Perna canaliculus. ``Karengo'' means the seaweed Porphyra spp. ``Kina'' means the echinoderm Evechinus chloroticus. ``Lessonia'' means the seaweed Lessonia variegata. ``Pacific oyster'' means the mollusc Crassostrea gigas. ``Pterocladia'' means the seaweed Pterocladia spp. ``Scallop'' means the mollusc Pecten novaezelandiae. ``Sea moss'' means the seaweed Gracilaria spp. ``Wakame'' means the seaweed Undaria pinnatifida. 3. Definition of spat For the purposes of any spat catching permit issued pursuant to section 67q of the Fisheries Act 1983, spat is hereby defined as: (a) any stage of the life cycle of the following molluscs: i. Dredge oyster less than 40 mm in length ii. Scallop less than 50 mm in length iii. Cockle less than 20 mm in length iv. Green-lipped mussel/Greenshell mussel less than 40 mm in length v. Blue mussel less than 30 mm in length vi. Pacific oyster less than 37 mm in length (b) any stage of the life cycle of the following seaweeds: i. Bladder kelp ii. Bull kelp iii. Wakame iv. Sea moss v. Karengo vi. Pterocladia vii. Lessonia (c) any stage of the life cycle of the echinoderm Kina with a test diameter less than 20 mm. 4. Revocation The Fisheries (Declaration of Species as Spat) Notice 1993 which appeared in a supplement to the New Zealand Gazette of 28 October 1993, Issue No. 158, at page 3246, is hereby revoked.
