Notice Pursuant to Section 114 of the Land Transfer Act 2017

The applicants described below have applied under section 114 of the Land Transfer Act 2017 for the removal of an energy supply right at South Auckland. The applicants claim the energy supply right is redundant by reason of the circumstances set out below.

I intend to remove the easement on 12 September 2022 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 12 September 2022.

Easement: Energy supply right over part Lot 1 DPS 85576 marked A on DPS 85576 in Record of Title SA68A/11 owned by Brian Michael Rogers, David William Holmes, Patricia Claire Hoskin and Lindsay Francis Grace for the benefit of Lot 2 DPS 85576 in Record of Title SA68A/12 owned by Mercury Willow Holdings Limited specified in Easement Certificate B581191.5 registered on 1 December 1999.

Circumstances: Extinguished because an event specified in the document creating it occurred and brought it to an end. The event being that the grant shall be for a term of 2 years from the date the registered proprietor of the dominant land, Selwyn Bruce Leach, ceases to be the registered proprietor of the benefited land.
