Notice is given under section 186(1) of the Land Transfer Act 2017 (“Act”) of an application to issue a record of title to a share in an access strip between Tai Paku Paku Road and Karaka Bay Road, Wellington.
We intend to create a record of title for a 1/18 share in the access strip in the name of the applicant unless a caveat under section 187 of the Act preventing the application from being granted is lodged with us by:
- the registered owner of a freehold estate in the access strip; or
- Wellington City Council
by 15 August 2022 or within a period extended by us under section 186(3) of the Act.
The applicant is claiming upon the grounds that they are the registered owner of a lot that adjoins the access strip. The access strip was set aside as part of subdivision on Deposited Plan 3318 for the purpose of providing access from adjoining owners to existing road (Karaka Bay Road) and is principally still being used for that purpose.
Access Strip: Between 357 and 363 Karaka Bay Road and 35 and 39 Tai Paku Paku Road, being 1067 square metres more or less, Lots 10 and 12 on Deposited Plan 3318 in Record of Title WN291/279 (as to a 4/9 share), Wellington Land District in the name of John William Doyland as to a 2/9 share and Frank Hatch as to a 2/9 share.
