Circumstances: The easement is extinguished because it is redundant in that the benefited land has been separated from the burdened land by subdivision on DP 437200, as a result the easement has no practical effect.
Easement: A right to convey water over part Lot 1 DP 66908 marked A on DP 66908 Record of Title (RT) WN35B/717 owned by Susan Roberta Perry, Bruce James McKelvie and James Robert Joseph Perry and Susan Roberta Perry, Alice Janet Buchanan Smith, and Bruce James McKelvie for the benefit of Lot 1 DP 437200 RT 537841 and Lot 2 DP 437200 RT 537842 both owned by Martock Farm Limited created by Easement Certificate registered on 3 October 1989 at 1.36pm.
