Under section 160(3) of the Crown Entities Act 2004, I, Freya Dean, Senior Solicitor, the Treasury, give notice that on 12 and 8 December 2021 respectively, the Honourable Grant Robertson, Minister of Finance, and the Honourable Christopher Hipkins, Minister of Education gave approval under section 160(1)(b) of the Crown Entities Act 2004, in relation to section 163(1) of that Act (restrictions on giving of guarantees and indemnities), for the Tertiary Education Commission (TEC) to give certain indemnities to David Ian Ruscoe and Malcolm Russell Moore, insolvency practitioners of Wellington and Auckland respectively (“liquidators”), in their capacities as liquidators of Taratahi Agricultural Training Centre (Wairarapa) Trust Board (in liquidation) (“trust board”). The indemnities are contained in clause 2.3(e) of the Deed of subordination executed by the TEC on 20 May 2021 in favour of the trust board and liquidators.
