Notice of Execution of Deed of Company Arrangement

Pursuant to Section 239ADY of the Companies Act 1993

At the watershed meeting of creditors on 25 August 2020, the creditors voted in favour of the company executing a deed of company arrangement (“DOCA”).

The DOCA was duly executed by the directors of the company and the deed administrators on 15 September 2020.

The DOCA may be viewed at www.business.govt.nz/companies by searching the company’s name.

Notice to Creditors to Lodge Claims

The deed administrators have fixed 23 October 2020 as the last day for creditors to make their claims and establish any priority their claims may have. Creditors who filed informal claims for voting purposes at the first meeting of creditors and watershed meeting must submit a formal claim for any amount owed as at 22 July 2020, if they wish to be included in any distribution available under the DOCA.
