Revisions to the Notice of Intention on the Process for Determining Input Methodologies for Fibre Fixed Line Access Services

The Commerce Commission (“Commission”) gives notice under section 179 of the Telecommunications Act 2001 that it has further revised the proposed process and timeframe for determining the input methodologies (IMs) for fibre fixed line access services (FFLAS) set out in its Notice of Intention dated 19 November 2018 (New Zealand Gazette, 19 November 2018, Notice No. 2018-au5843).

The Key Revisions

The Commission published a further consultation determination and reasons paper, relating to changes we are considering making to our draft decisions on IMs for FFLAS (other than our approach to valuing the financial loss asset) on 23 July 2020.

The Commission published a second further consultation determination and reasons paper, relating to changes we are considering making to our approach to valuing the financial loss asset, on 13 August 2020.

The dates for publishing the final FFLAS IMs and the reasons papers explaining the final decisions has been extended from September/October 2020 to:

  • 13 October 2020 in respect of the final FFLAS IMs (excluding our approach to valuing the financial loss asset); and
  • 3 November 2020 in respect of the final FFLAS IMs relating to our approach to valuing the financial loss asset.
