Notice Title

Land and Easement Acquired, Ruapekapeka RoadFar North District Council

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Janine Stocker, Land Information New Zealand, declares that:

  1. pursuant to an agreement to that effect having been entered into, the land in the First Schedule to this notice is acquired for sewage treatment purposes and shall vest in the Far North District Council;
  2. an easement in gross, described in the Third Schedule to this notice, is acquired over the land of Brian Frederick Harricks and Whitlock Williams Trustee Ltd (“Grantor”), described in the Second Schedule to this notice, upon the terms and conditions set out in the Sixth Schedule to this notice and shall vest in the Far North District Council (“Grantee”);
  3. the easement described in the Fourth and Fifth Schedule is reserved in favour of the Grantor’s land described in the Second Schedule, on the terms and conditions in the Seventh Schedule, on the date of publication of this notice in the New Zealand Gazette.

Part Section 7 Suburbs of Waiomio shown as Section 2 on SO 493348 and Section 8 Suburbs of Waiomio, SO 493348, comprised in Record of Title NA67/283 (“Grantor’s Land”).

Third Schedule

Easement in Gross Acquired

A right to drain sewage easement in gross over those parts of the Grantor’s Land marked “A”, “B”, “C” on SO 493348.

Fourth Schedule

Easement Reserved

A right to convey electricity for stock fencing only marked “D” on SO 493348.

Fifth Schedule

Easement Reserved

A right to convey water marked “E” on SO 493348.

Sixth Schedule

Easement Rights and Powers

The rights and powers implied in the easement shall be the rights and powers set out in the Schedule 5 to the Land Transfer Regulations 2018.

Seventh Schedule

Easement Rights and Powers

The rights and powers implied in the easement shall be the rights and powers set out in the Schedule 5 to the Land Transfer Regulations 2018, and the revocation without compensation as provided for in section 48 of the Public Works Act 1981, is expressly excluded.

The implied rights and powers are hereby added to by:

  1. The Grantee covenants with the Grantor that the Grantee will supply to the Grantor, 500 cubic metres of water annually, free of charge.
