Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied under section 70 of the Land Transfer Act 1952 for the removal of a right of way and right to convey water. The applicant claims the right of way and right to convey water is redundant by reason of the circumstances set out below.

I intend to remove the right of way and right to convey water on 3 September 2018 if no objections have been received before that date.

Easement: Right of way over part Lot 2 Deposited Plan 20243 marked “A” and right to convey water over part Lot 2 Deposited Plan 20243 marked “B” on Deposited Plan 20243 comprised in Computer Register NL13B/1285 created by Easement Certificate 365188.13, registered on 5 February 1997.

Circumstances: The dominant land has become physically separated from the servient land as a result of subdivision Deposited Plan 513715 and Deposited Plan 517683.
