Notice Pursuant to Section 70 of the Land Transfer Act 1952

An application, under section 70 of the Land Transfer Act 1952, has been received for the removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 13 July 2018, the Register will be updated to record the easement as redundant.

Easement: Right to drain sewage marked A, B, C, D and E, right to convey water and electricity marked B, K, F, G, D and H and a right to convey water marked L, all on SO 455144 over Section 3 SO 455144 and a right to convey water marked M and N on SO 455144 over Section 4 SO 455144 contained in CT 628093 (servient tenements) appurtenant to Lots 2 and 5 DP 470387 contained in CTs 636070 and 801244 (dominant tenements), a right to convey water and electricity marked J on SO 455144 over Section 2 SO 455144 and marked B and I on SO 455144 over Section 3 SO 455144 contained in CT 628093 (servient tenements) appurtenant to Section 8 SO 455144 contained in CT 636070 (dominant tenement) and a right to convey water and electricity marked B, F and AP on SO 455144 over Section 3 SO 455144 contained in CT 628093 (servient tenement) appurtenant to Section 9 SO 455144 contained in CT 636070 (dominant tenement) created by Easement Instrument 9610942.8 registered on 6 January 2014.

Circumstances: The easement has expired as AE Field & Sons Limited has ceased to be the registered proprietor of the land (dominant tenements) adjoining the servient land.
