Notice Pursuant to Section 70 of the Land Transfer Act 1952

An application under section 70 of the Land Transfer Act 1952 has been received for the removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below.

If no objections have been received before 26 April 2018, the register will be updated to record the easement as redundant.

Applicant: Munro Holdings Limited, c/- Bay Online Services Limited, Private Bag 12011, Tauranga Mail Centre, Tauranga 3143.

Easement: Right of way, right to convey water, telephonic communications and electric power over Lot 200 DP 515897 marked A on DP 518597 contained in CFR 813483 (servient tenement) appurtenant to Lot 1 DP 355615 contained in CFR 226891, Lot 2 DP 355615 contained in CFR 226892, and Lot 3 DPS 84340 contained in CFR SA66D/915 (dominant tenements) created by Easement Certificate B067461.2 registered on 21 February 1992.

Circumstances: The dominant tenements have become physically separated from the servient tenement as a result of subdivision shown on DPS 84340.
