Notice Declaring Removal and Addition of Aquaculture Settlement Areas in Lucas Bay, Akaroa Harbour (Canterbury Region) for the Purposes of the Maori Commercial Aquaculture Claims Settlement Act 2004 (Notice No. MPI 889)

Pursuant to section 12 of the Maori Commercial Aquaculture Claims Settlement Act 2004, the Minister of Fisheries gives the following notice.

Notice

1. Title and Commencement

(1) This notice may be cited as “Notice Declaring Removal and Addition of Aquaculture Settlement Areas in Lucas Bay, Akaroa Harbour (Canterbury Region) for the Purposes of the Maori Commercial Aquaculture Claims Settlement Act 2004”.

(2) This notice comes into force on the day after it is gazetted.

2. Removal of Existing Areas Gazetted for Settlement Purposes

Under section 12(2)(a) of the Maori Commercial Aquaculture Claims Settlement Act 2004 (“Act”) the Minister of Fisheries declares that the whole of the two existing Aquaculture Settlement Areas in Lucas Bay, Akaroa Harbour, created by the New Zealand Gazette notice set out below, are removed as Aquaculture Settlement Areas:

3. New Areas Declared for Settlement Purposes

Under section 12(1) of the Act the Minister of Fisheries declares two new Aquaculture Settlement Areas in Lucas Bay, Akaroa Harbour. The boundaries of the two new Aquaculture Settlement Areas are represented by the coordinates set out below:

The area enclosed by a line:

  1. commencing at a point offshore (at 43°52.354′S and 172°55.548′E); then
  2. proceeding in a north-easterly direction to a point offshore (at 43°52.284′S and 172°55.655′E); then
  3. proceeding in a south-easterly direction to a point offshore (at 43°52.488′S and 172°55.845′E); then
  4. proceeding in a south-westerly direction to a point offshore (at 43°52.557′S and 172°55.738′E); then
  5. proceeding in a north-westerly direction to the point of commencement.

(2) Lucas Bay (South), Akaroa Harbour

  1. commencing at a point offshore (at 43°52.574′S and 172°55.822′E); then
  2. proceeding in a north-easterly direction to a point offshore (at 43°52.473′S and 172°55.858′E); then
  3. proceeding in a south-easterly direction to a point offshore (at 43°52.564′S and 172°56.173′E); then
  4. proceeding in a south-westerly direction to a point offshore (at 43°52.665′S and 172°56.137′E); then
  5. proceeding in a north-westerly direction to the point of commencement.
