Notice of Exemption From Maritime Rules

Pursuant to section 47(3) of the Maritime Transport Act 1994, the Director of Maritime New Zealand hereby notifies the granting of the following exemptions on 8 December 2017:

  • 1 from Maritime Rule 40A.19(1), Table 40A.2 – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Egress requirements and measurements.
  • 1 from Maritime Rule 40A.19(3)(a) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Provision of ready egress from decks or compartments accommodating 12 or less passengers.
  • 1 from Maritime Rule 40A.19(4) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Ladderways required by subrules (3) and (6) – Measurements and requirements.
  • 1 from Maritime Rule 40A.19(5) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Stairways required by subrules (3) and (6) – Measurements and requirements.
  • 1 from Maritime Rule 40A.19(6)(a) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Two means of escape must be provided from all levels of passenger accommodation – Stairway below weather deck and either trunked ladderway or stairway.
  • 1 from Maritime Rule 40A.29(2)(a)(iii) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Bilge piping – Non-metallic bilge piping may be used in non-metallic hulled ships.
  • 1 from Maritime Rule 40A.35(6) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Sea water piping must be of marine quality metal except in ships less than 24m in length overall and suitable reinforced synthetic rubber piping may be used in short lengths for vibration damping.
  • 1 from Maritime Rule 40A.52(1) – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – General requirements – Fire-resisting standards for doors and other closures of openings within the bulkheads forming fire-resisting divisions.
  • 1 from Maritime Rule 40A.60 – Design, Construction and Equipment – Passenger ships which are not SOLAS ships – Anchors and cables – Testing and marking requirements of anchors and chain cables.
  • 1 from Maritime Rule 40C.16(2) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Shelter and passenger accommodation requirements on ships proceeding beyond restricted limits carrying 12 or less passengers.
  • 1 from Maritime Rule 40C.25(2)(a)(iii) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Bilge piping – Non-metallic bilge piping may be used in non-metallic hulled ships.
  • 1 from Maritime Rule 40C.32(6) – Design, Construction and Equipment – Non-passenger ships that are not SOLAS ships – Sea water piping must be of marine quality metal except in ships less than 24m in length overall and suitable reinforced synthetic rubber piping may be used in short lengths for vibration damping.

  • 1 from Maritime Rule 40D.44(1)(d) – Design, Construction and Equipment – Fishing Ships – Doors in fire-resistant divisions – Doors fitted in boundary bulkheads of machinery spaces of category A must be self-closing and reasonably gastight.
  • 1 from Maritime Rule 40D.57(2)(a) – Design, Construction and Equipment – Fishing Ships – Means of escape must be a stairway and the second means of escape must be a trunk or a stairway.
  • 1 from Maritime Rule 40D.73 – Design, Construction and Equipment – Fishing Ships – Testing and marking requirements for anchors of more than 75kgs weight and chain cables of 12.5mm in diameter.
  • 1 from Maritime Rule 40E.21(5) – Design, Construction and Equipment – Sailing Ships – Openings in the hull – Portlights – Compliance of requirements of standard ISO 12216.
  • 1 from Maritime Rule 40E.21(6) – Design, Construction and Equipment – Sailing Ships – Openings in the hull – Portlights of a type that have at least two screw up dogs must be secured closed when the ship is in navigation.
  • 1 from Maritime Rule 40E.26(5) – Design, Construction and Equipment – Sailing Ships – Openings in the hull – Metal piping must be used in bilge systems of ships of 12m or more in length except with submersible bilge pumps or in non-metallic hulled ships, if the pipe material and arrangements are acceptable to a surveyor.
  • 1 from Maritime Rule 40E.56 – Design, Construction and Equipment – Sailing Ships – Openings in the hull – Testing and marking requirements for anchors of more than 75kgs weight and chain cables of 12.5mm in diameter.
  • 1 from Maritime Rule 41.4 – Anchors and Chain Cables – Anchors – Owner of ship must not fit anchors manufactured outside New Zealand unless examined and tested.
  • 1 from Maritime Rule 41.5 – Anchors and Chain Cables – Chain cables and accessories – Owner of ship must not fit any chain cable or accessory manufactured outside New Zealand unless examined and tested.
  • 1 from Maritime Rule 49.13(c) – Ships’ Lifting Appliances – Owner of New Zealand ship fitted with cargo or vehicle lifts and vehicle ramps must ensure these are thoroughly examined at least once in every 6-month period.
