Authorised Access to Certain Names and Addresses Held on the Motor Vehicle Register

Pursuant to section 241 of the Land Transport Act 1998 (“Act”), I authorise the following person, for the purpose(s) and the term, and on the conditions stated below, to have access to the names and addresses of persons:

  • who are currently registered in respect of a motor vehicle(s); and
  • who have not instructed the Registrar of Motor Vehicles to withhold their details.

Person: Motor Industry Association (MIA)

Purpose(s):

  • Service campaigns for software updates to vehicle’s safety assist and autonomous systems and for upgrades to engine management systems for improvement environmental performance.
  • Verify ownership for warranty, customer support and/or other purposes.
  • Provide customer support to queries regarding privately imported vehicles of which information is not available by other means.
  • Confirming ownership of a vehicle (to validate that new stock has not been registered without advice given to the distributor).
  • Sales auditing including dealer demonstrators where vehicles must be retained for a set period prior to any change of ownership.
  • Verifying customer and vehicle ownership details before supply of security related information.
  • Warranty and extra care contract expiry reminders so customers can be made aware and offered a new product.

Term: The authorisation is valid for a period of 5 years commencing 6 July 2018 and ending at midnight on 5 July 2023.

Conditions

  1. The names and addresses are accessed only by the authorised persons on their own behalf and solely for their own use;
  2. only existing customers are approached/contacted;
  3. the names and addresses are accessed only for a specified purpose;
  4. the fees charged for the provision of the names and addresses from the Motor Vehicle Register are duly paid;
  5. any identified instances of unauthorised access are immediately notified to the Secretary for Transport and the Privacy Commissioner;
  6. before being permitted to access the Motor Vehicle Register under section 241 of the Act, all new staff must receive training that emphasises that such access must only be for a specified purpose, and refresher training of all staff also must be undertaken at appropriate intervals;
  7. access must be restricted solely to members of staff for whom authorised access is essential for achieving a specified purpose;
  8. the names and addresses obtained under this authorisation shall not be disclosed to any third party unless such disclosure is necessarily incidental to achieving a specified purpose;
  9. everyone contacted through names and addresses accessed under this authorisation must, at the first opportunity, be informed of their right to opt out under section 241(7)(b) of the Act, and also that they may request that the authorised person immediately remove them from its mailing list so that they will not receive any further marketing or market research-related correspondence; and
  10. compliance with the terms and conditions, if any, imposed by the NZ Transport Agency for access to Motor Vehicle Register information.
  11. all members and the MIA are required to keep summary records of each section 241 enquiry for one year, from the date on which register data was accessed.
  12. the member and the MIA must provide information to the Registrar of Motor Vehicles and in all other respects assist with any audit of their access to name and address information
  13. NZTA be consulted on any changes to the MIA Code of Practice document;
  14. MIA undertakes random audits on their members and sends the details in an annual report to NZTA next due by 31 July 2019.
